A private developer has been given the right to evict people from an island deep inside Tasmania’s Wilderness World Heritage Area, outraging fishermen and bushwalkers.

"A private developer has been given the right to evict people from an island inside Tasmania’s Wilderness World Heritage Area and to install surveillance cameras, outraging fishermen and bushwalkers.
The Australian has obtained correspondence from the head of Tasmania’s Parks and Wildlife Service confirming such rights are held by Wild Drake, which was controversially given an exclusive lease to develop a tourist project on Halls Island.
PWS general manager Jason Jacobi wrote to a fishers and walkers group on August 11, confirming Wild Drake could install cameras for any use without ­approval and could evict anyone visiting the island.
“As lessee, Wild Drake has the same rights and obligation as any citizen to manage its property in the land in accordance with the law,” Mr Jacobi said in response to questions about the company’s powers of eviction.Similarly, as the company — fronted by developers Daniel and Simone Hackett — had “exclusive possession” of the island, at Lake Malbena in the Walls of Jerusalem National Park, it could “choose to use cameras (monitoring or otherwise) without PWS approval”.
The group that elicited the ­response from Mr Jacobi said it was “horrified” a private company had been granted such sweeping powers over a World Heritage Area and national park.
“It seems the developer has the right to evict us from a World Heritage Area, which we find a really frightening and astounding turn of events,” said Dan Broun of Fishers and Walkers Against Helicopter Access.
“The penalty of up to six months in jail or a $1680 fine for being in a national park and world heritage area, for ordinary bushwalkers, is abhorrent.”
Mr Hackett said people could apply to visit the island and claimed the cameras were used for environmental monitoring.
In late 2018, The Australian revealed the Hacketts had been granted a secret “exclusive possession” lease over the island. The proposal, currently tied up in Supreme Court legal action, has become a lightning rod for dissent at the state government’s policy of luring tourism projects to parks and wilderness areas.

TICT and Wilderness Society trade barbs over major projects laws
The contentious Lake Malbena development has become the battleground for the state’s tourism industry body and environmentalists, who are accusing each other of holding conflicting positions on Major Projects laws.

ENVIRONMENTALISTS have accused the state’s peak tourism body of duplicity over the state’s major project laws.

In return, Tourism Industry Council of Tasmania chief Luke Martin says the Wilderness Society was itself now defending the existing planning system which it has constantly derided and challenged in court.
Mr Martin commented on Twitter earlier in the week that he did not understand why people were concerned the proposed major projects laws could be applied to a proposed tourism development in the Tasmanian Wilderness World Heritage Area.

“Why is Lake Malbena consistently being referenced in relation to Major Projects Legislation? a) it’s not a major project, and b) it’s been through the planning system. It’s irrelevant to the debate,” he said.

But the TICT’s submission on the bill welcomes the its application to projects in protected areas.

“We are pleased there is no proposed minimum monetary threshold on the scale of projects to be considered as Major Project under the amendments, as was considered in the initial consultations on the reforms and is in place in some other jurisdictions,” the submission reads.

“We see the potential for this Major Projects process to be triggered for complex development

proposals within Tasmania’s protected areas, instilling experts into the decision making about

projects of unusual environmental, scientific, and economic complexity.

“This can only be a good thing.”

Tom Allen from the Wilderness Society said he believed the tourism industry was sending a mixed message.

“The TICT submission validates our worst fears that this legislation will be used to fast-track private commercial developments in Tasmania’s public nation parks,” he said.

While publicly suggesting that we were scaremongering, behind the scenes, the TICT was advocating for exactly what the Wilderness Society was warning could happen to national parks using the major projects laws put forward by Tasmania’s Liberal Government.

“With wilderness the single biggest driver of Tasmania’s tourism industry, it’s hard to see how the state’s tourism operators can be comfortable with their peak body advocating for more and faster developments of the state’s world-class national parks and wild places.”

Mr Martin said his comments referred to projects were beyond the expertise and resources of local councils to deal with in a timely and efficient fashion.

“The reality is we’re looking ahead to projects like the Tyndall ranges walk and Cradle Mountain cableway project,” he said.

He said it was ironic that the Wilderness Society was going into bat on behalf of the existing planning system — which it had challenged and derided in the Lake Malbena approvals process.

Just to re-cap. They rezoned a wilderness area because a developer told them to. Secretly changed the management plan to allow helicopter access. Signed a lease giving "exclusive possession" of an entire island for slightly more than the lease cost of a rubbish tip. Ignored their own advisory Council (the National Parks and Wildlife Advisory Council) , Aboriginal Heritage Council and Central Highlands Council. Ignored 98% of public submissions, fishers, bushwalkers, everyone who has put pen to paper, made phone calls, protested in the rain, walked in and reclaimed Malbena, signed a petition, lobbied Tasmanian Labor lobbied the Tasmanian Liberals and written to Jason Jacobi and Tim Baker as heads of Tasmania Parks and Wildlife Service. The Tourism Industry Council Tasmania has called the campaign "hysterical" and labelled the Lake Malbena disaster as "on brand". It's a disgrace. If the head of Parks signs this off it will be their legacy to have ignored all of these groups and individuals, made every national park, every peaceful lake, every favourite fishing ground and every protected area up for grabs. The federal environment minister has ordered an assessment of the Lake Malbena tourism proposal in response to a Federal Court ruling from last year which set aside the government's original approval.

Environment Minister Sussan Ley has since reconsidered the matter in light of the ruling, and informed proponent Wild Drake Pty Ltd of her decision on Thursday.

The court had found that the original decision by former environment minister Melissa Price that no approval was required had been flawed.

Ms Ley has now decided that the proposal be assessed as a Controlled Action under the Environment Protection and Biodiversity Conservation Act.

Analysis of this decision is underway and one of our speakers on Sunday will give an overview of what this means.

On face value it's good - we've always maintained this should be declared a controlled action under the EPBC Act - but under what conditions the assessment is to be made is unclear at the moment. One thing is for sure public comment can be made under this process and we will be encouraging everyone to make a submission. Ramifications for other proposals under the dodgy EoI / RAA process are unclear but potentially very positive. The fight goes on.

Auditor Generals report into the EOI process dropped yesterday. Despite some shallow reporting in The Mercury and others in the media, deep analysis shows it up for what it is - a grand wilderness heist to benefit a few and destroy the wild.

THE Wilderness Society has urged a panel of judges to find errors were made when a helicopter eco-tourism venture was given the green light.

On Friday, lawyers for the environmental group appeared before the Full Court of Supreme Court in Hobart via video link, in the organisation’s latest bid to block the controversial Lake Malbena project.

The Wilderness Society and the Tasmanian National Parks Association have been fighting developer Wild Drake in a series of court clashes since the project was first knocked back in February 2019 by the Central Highlands Council.


The case has wound its way through the appeals system, with Wilderness Society campaign manager Tom Allen proclaiming that Tasmania’s natural areas were “worth fighting for”.


But Wild Drake, run by husband-and-wife team Daniel and Simone Hackett, isn’t backing down either and has won the support of the state government

Friday’s hearing pivoted on how provisions contained within the region’s planning scheme should be correctly construed.

If the Wilderness Society wins its appeal, Tasmania’s Resource Management and Planning Appeal Tribunal could be ordered to set aside its previous approval to grant Wild Drake a planning permit, and instead make a new decision.

Lake Malbena is located in the Walls of Jerusalem National Park.

Justice Michael Brett, Chief Justice Alan Blow and Acting Justice David Porter reserved their decision to a later date.

Federal Environment Minister Sussan Ley is yet to announce if she will approve the project

And finally some good news for Lake Maslbena,
surprisingly from a federal liberal ministers office!

Minister Sussan Ley MP has today released a "statement of reasons" for her decision to re-assess the Malbena farce. The Minister has completely contradicted Tasmania's Head of Tasmania Parks and Wildlife Service Jason Jacobi, who in November 2019 told the ABC that "Daniel and Simone Hackett have shown that helicopter access into Halls Island can be managed appropriately". Commonwealth Minister for the Environment states today; the impact from the use of helicopters on the World Heritage Area was " likely to be significant" and the scale of loss of Wilderness values was "substantial" (full document in link below)... There is something very rotten about senior bureaucrats in Tas that are so willing to champion the destruction of our wild places for so few and with so little concern. This debacle needs to end. 79. Having considered the advice in the recommendation brief and the attached material,
I found that the impact on the world heritage values of the TWWHA from the use of
helicopters is likely to be significant.

action.

The evidence is indeed 'overwhelming'... and yet an outcome needs intervention at levels of court and government to highlight the point all concerned parties have been making from the start (praise at any level seems 'kid gloves')

So, what next, is this a win? or submitting to acceptance of testing dodgy outcomes for their fit with equally dodgy management plans?

My question is what happens when the State Liberal gov get backed into a corner? they have championed this from the beginning, backed the proponent in appeals and repeatedly supported the process in which it has been handled. I fear a situation like the US when the refs call might not be enough to get this in the bin where it belongs...

If anyone based in Hobart would like to meet campaign organisers and get regular updates feel free to drop by 'The Duke' every second Monday.

This coming Monday the 23rd, Claire Bookless, Managing Lawyer with the Environmental Defenders Office will be giving an update and answering questions from a legal perspective. We also get to support a local business that supports us by buying some food and bevies.

We need to be ready for a mass submission writing exercise when the EPBC review opens for public comment - once announced we only have 14 days to get those submissions in to the minister. This will be the most useful thing people can do in the near future.

When making a submission, it's very important to use your own words. Certainly be guided by TWS et al, but your words are far better than a pro forma. It may be possible to recycle Central Highlands Council submissions. Not much has changed regarding environmental and economic impacts of the proposal.

x2 - having worked in several places that deal with submissions day to day, if it looks like a campaign, change.org or similar it may receive less weighting than original submissions.

Each agency has their own views on this but it is common to see campaign cut and pastes marked as nil action/response.

How many different opposing arguments are there? I can only think of the need to protect designated wilderness, the place and the concept. It's simple/ could be counted on one finger.. I hope these lawyers and the conservation corps (of the day) settle for nothing less, or they might as well join the developers. Accepting a better process, gilded in greenwash, is less. Let's not forget, through the heights of green popularity in Tassie the collective helped save a river and then, while reveling in a 'win', let these commercial developments in.
